Terms of Use

These terms are an agreement between you and Flutter Love Inc. ("Flutter Love", "we", "us"). They cover your use of the Flutter Love app and website. By creating an account, you agree to them. Please also read our Privacy Policy.

1. Who can join

• You must be at least 18 years old.
• You must be single, or legally able to marry, and looking for a serious, long-term relationship.
• You may have only one account, and it must be about you. Your name, age, photos and details must be accurate.
• You must not be barred from using a service like ours by law, and must not have been convicted of a violent or sexual offence.

2. Invitations and approval

Flutter Love is invite-only. You need a valid invite code to sign up. Every application is reviewed by a person. We decide at our discretion whether to approve an application, and we don't have to give a reason. Until you're approved, you can't see other members, and they can't see you.

If you invite someone, you're vouching that they're a real person you know. Your invite code is for the people you choose. Please don't sell it or share it publicly.

3. Introductions

Flutter Love may introduce members to each other directly. Some introductions appear as a match right away. Others arrive as a request that you can accept or ignore. Introductions may be arranged by the people who run Flutter Love, including on their own behalf. Every introduction is shown only as "A Flutter Love introduction", and does not identify who arranged it.

After any introduction you can unmatch, report or block, as with any match. If you don't accept a request, the person who asked isn't told whether you declined it or simply didn't respond, and you won't be asked by them again.

4. Zero tolerance for objectionable content and abuse

We have zero tolerance for objectionable content and abusive behaviour. You must not:

• harass, threaten, bully, stalk or intimidate anyone;
• post or send sexually explicit, hateful, violent or discriminatory content;
• send unwanted sexual messages, or sexual content of any kind involving minors;
• impersonate anyone, misrepresent yourself, or use someone else's photos;
• ask anyone for money or financial information, promote anything, or run scams;
• share another member's personal information, photos or messages without their consent;
• use the service for any illegal purpose, or for commercial activity;
• scrape, copy or collect data from the service, or interfere with its security.

You can report a member, and block or unmatch them, from any chat. A person reviews every report. We aim to act on reports within 24 hours. If a report is found to be valid, we remove the content and suspend or remove the account that posted it. To investigate a report, we may read the conversation it was made from, as explained in our Privacy Policy.

5. Your safety

FLUTTER LOVE DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENINGS OF ITS MEMBERS.

We review applications, but the review doesn't include a criminal background check or identity verification, and we can't verify everything members tell us. You are responsible for your own safety when you communicate with or meet other members. Meet in public, tell someone you trust where you'll be, and never send money to someone you've met through the service. Read our safety tips.

6. Your content

You own the photos, text and messages you add ("your content"). You give us a worldwide, non-exclusive, royalty-free licence to store, process and display your content, only to run the service. For example, we show your profile to other approved members, and deliver your messages. This licence ends when you delete the content or your account, except for anything we must keep, as described in our Privacy Policy.

You're responsible for your content. You must have the right to share it, and it must follow these terms. We may review it, and remove it if it breaks them.

7. Suspending and ending your account

You can delete your account at any time in the app, under Account → Delete account. We may suspend or remove your account, without notice, if you break these terms, if we believe you put other members at risk, or if we're required to by law. A suspended account is hidden from all other members.

8. The service

Flutter Love is currently free. We'll tell you before we introduce any paid features. We may change, pause or stop the service, or any part of it. We don't guarantee that you'll be matched, meet anyone, or find a partner.

9. Disclaimers and liability

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the service will be uninterrupted, secure or error-free.

To the fullest extent the law allows:

• we aren't responsible for the conduct of any member, on or off the service;
• we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of the service; and
• our total liability to you for all claims relating to the service is limited to the greater of US$100 or the amount you paid us in the 12 months before the claim arose.

These limits don't apply to liability that can't be limited by law, such as for fraud, gross negligence or wilful misconduct. Nothing in these terms limits any rights you have under consumer protection law that can't be excluded.

You agree to indemnify Flutter Love Inc. against claims by third parties arising from your content, your conduct toward other members, or your breach of these terms.

10. Apple

If you downloaded the app from the App Store, these terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance for the app. Apple isn't responsible for any product claims, including claims that the app breaks any law or infringes anyone's rights. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You also agree to Apple's Licensed Application End User License Agreement.

11. Changes to these terms

If we make material changes, we'll tell you in the app or by email before they take effect. If you continue to use the service after that, you accept the new terms.

12. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. If you have a dispute with us, please contact us first at [email protected] so we can try to resolve it informally. Any dispute that isn't resolved will be decided exclusively by the state or federal courts located in San Francisco County, California, and you and we consent to their jurisdiction. If you live outside the United States, this doesn't take away any protection of the mandatory law of the country where you live.

13. General

These terms, with our Privacy Policy, are the whole agreement between you and us about the service. If any part is found unenforceable, the rest stays in effect. If we don't enforce a part of these terms, that isn't a waiver. You can't transfer your rights under these terms; we may transfer ours as part of a merger, acquisition or sale of assets.
